Introduction

By accessing or using the Session Testnet Software (the "Software") and/or claiming (or attempting to claim) any Session Testnet test SENT tokens (“tSENT Tokens”), you agree to comply with and be bound by the following terms and conditions ("Terms"). Please read these Terms carefully. If you do not agree to these Terms, you must not use the Software or attempt to participate in the Program.

Definitions

- "We," "us," and "our" refer to the developers, operators, and maintainers of the Software working for, on behalf of, or at the direction of the Session Technology Foundation.

- "You" and "your" refer to the user of the Software and/or Program participant.

- "Software" refers to the public testnet software provided for testing purposes with respect to the Session Network.

- “Session Token” refers to the token that will be issued intended for cryptographically secured digital token known as the Session Token where that token is to be used as part of the operations of the software underlying the Session messaging application and protocol.

- “Program” means the program by which the Session Technology Foundation may grant tSENT Tokens to users who complete certain tasks with respect to the Software and tSENT Token claims.

Purpose

The Program is intended to encourage users to participate in testing the Software and to encourage them to encourage others to do so. The Software is provided for testing and evaluation purposes only. It is not intended for production use, and we do not guarantee its availability, performance, or suitability for any particular purpose.

The Session Technology Foundation retains sole and absolute discretion with respect to participation in the Program and the award of any tSENT Tokens for such participation.

tSENT Tokens are exclusively for use on the Session testnet Software and do not have, and are not intended at any time to have, any monetary value.

Incentive Awards

Any incentive or other award of tSENT Tokens (or any other token, asset or other award) is entirely at the discretion of the Session Technology Foundation. Without prejudice to the foregoing, it is intended that users may be awarded tSENT Tokens by completing certain activities, such as inviting other potential participants using an invitation code provided by the Session Technology Foundation for this purpose, and those potential participants successfully joining the Software test program having used the relevant invitation code and claiming tSENT Tokens from a faucet deployed for that purpose. We may communicate additional or alternative activities or requirements for participation and may amend, extend or withdraw any activity or requirement at any time.

There is also a testnet incentive program pursuant to which users may be eligible to receive Session Tokens (in accordance with the applicable terms and conditions). The Program is not linked to the testnet incentive program and any award of tSENT Tokens pursuant to the Program does not entitle you to any award or allocation of Session Tokens (without prejudice to the terms applicable to any other relevant program with respect to Session Tokens and the discretion of the Session Technology Foundation with respect to any award or grant).

License

Your use of the Software is subject to the terms and conditions applicable to it, including (without limitation), the license incorporated in those terms and conditions.

User Responsibilities

1. Compliance: You agree to comply with any applicable law, regulation, or decision, order or direction of any court, arbitrator, regulator or other governmental or supranational authority while participating in the Program. You must be at least 18 years of age and have reached the legal age of majority in the jurisdiction in which you reside.

2. No Harmful Activity: You must not engage in any activity that is illegal, harmful, or disruptive to the Software, the network or other users, or any third party’s software, services, products or users.

3. Feedback: You agree to provide us with feedback on the Software, including reporting any bugs, issues, or suggestions for improvement.

Intellectual Property

All intellectual property rights in the Software and all other components of the Program, including but not limited to copyrights, trademarks, and trade secrets, are owned by us or our licensors. You do not acquire any ownership rights by using the Software or participating in the Program.

Data Privacy

By participating in the Program, you hereby (a) grant us the right to use the name, country of residence, email address and any other information provided to us (“Personal Information”) for the purpose of administering the Program; and (b) acknowledge that we may disclose Personal Information to our third-party agents and service providers who are involved in the administration and/or oversight of the Program, development of the Software, and issuance and delivery of the tSENT Tokens and/or Session Token.

Disclaimers

1. No Warranty: The Software is provided "as is" and "as available," without any warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

2. Limitation of Liability: We are not liable for any loss or damage you may incur, directly or indirectly, as a result of your participation in the Program or use of the Software (or any attempt to participate in the Program or use of the Software). In no event shall we be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of or related to your use of the Software.

Termination

We reserve the right to terminate your participation in the Program and/or access to the Software at any time, with or without cause, and without prior notice, and to cancel, reduce or rescind any award of tSENT Tokens that may have previously been communicated to you.

Changes to Terms

We may update these Terms from time to time. If we make material changes, we will notify you by posting the updated Terms on our website or through other means. Your continued participation in the Program and/or use of the Software after such changes constitutes your acceptance of the updated Terms.

We may communicate other information, policies, criteria and proposals with respect to the operation and administration of the Program and, where such communications include requirements, conditions, or other terms with respect to the Program and participation in it, those communications will be deemed to form part of these Terms. In the event of any conflict or inconsistency between such communications and these Terms, these Terms prevail.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Canton of Zug, Switzerland.
